Section 01

Introduction

Welcome to "Belamoshwar", the digital platform dedicated to delivering and facilitating healthcare and medical services in the Republic of Sudan. The application aims to create intelligent technical connectivity between users and an elite network of doctors, medical laboratories, pharmacies, and hospitals, in addition to providing remote medical consultation services (Telemedicine).

Downloading the app, registering an account, or browsing the website constitutes your explicit, conscious, and legally binding consent to adhere to all terms and conditions set forth herein. If you do not agree to any of these terms, please immediately stop using the application and uninstall it.

Section 02

First: Definitions

Unless the context otherwise dictates, the following terms and expressions shall have the meanings ascribed opposite each of them:

The Application / Platform: "Belamoshwar" application and website with all its features, updates, and software systems provided in Sudan.

The User: Any natural person who creates an account or benefits from medical and digital services displayed via the application.

Platform Partners (Service Providers): Doctors, pharmacies, laboratories, healthcare centers, and hospitals legally licensed by official authorities and registered to offer services to users via the platform.

Account: The dedicated digital space for the user to access platform services, created using registration credentials (phone number, email address, password).

Services: All digital and logistical health solutions provided by the application, including remote telemedicine consultations, lab tests and appointment booking, and medication dispensing and delivery.

Section 03

Second: Scope of Services

"Belamoshwar" provides a digital gateway facilitating access to the following services:

Remote Medical Consultations (Telemedicine): Direct video, audio, or text communication with specialized doctors according to health regulations and standards in Sudan.

Laboratory & Diagnostic Services: Booking medical lab tests, requesting home sample collection, and receiving electronic results securely.

Pharmacy Connectivity: Ordering medications, health products, and supplements electronically, with safe delivery options when available.

Appointment Scheduling: Coordinating and facilitating direct appointment reservations inside hospitals and healthcare clinics.

Awareness materials, health articles, and medical information published across the application are for general informational and educational guidance only, and under no circumstances constitute a diagnosis or a substitute for direct in-person medical examination and physician consultation.

Section 04

Third: Registration and Account Conditions

The user must possess full legal capacity to enter into binding agreements and must not be less than 18 years of age.

The account is strictly personal; sharing login credentials with third parties is strictly prohibited, and the user remains legally responsible for all activities and orders placed through their account.

The user commits to providing accurate, truthful, and up-to-date data (name, address/location, basic medical history), and updating it immediately upon changes.

Platform administration reserves the right to suspend, restrict, or ban the account of any user immediately and without prior notice if found submitting misleading data or utilizing the platform in violation of prevailing laws or this agreement.

Section 05

Fourth: Fees and Payment Mechanism

Downloading the application and browsing some of its services is free of charge, whereas consultations, laboratory bookings, and medication orders are subject to specified fees clearly and transparently displayed prior to order confirmation.

All payments are processed through certified, secure electronic payment gateways operating within the Republic of Sudan, and the user bears full responsibility for the validity and activity of their electronic card or digital wallet.

In case of electronic payment failure, the platform reserves the right to automatically cancel the reservation or suspend the service until payment is completed successfully.

Section 06

Fifth: Cancellation and Refund Policy

The user is entitled to cancel an appointment or test and receive a full or partial refund, provided cancellation occurs within the permitted time window clearly specified on the service confirmation page.

The user is not entitled to claim any financial refund if cancellation occurs after the expiration of the permitted window, after the medical consultation has commenced, or after the lab/pharmacy representative has dispatched for home delivery.

In the event service delivery cannot be fulfilled by the doctor or platform partner due to technical server malfunction or force majeure, the full amount paid will be refunded automatically to the user's platform wallet or original payment method within a period not exceeding 7 business days.

Section 07

Sixth: Medical Responsibility and Platform Liability Boundaries

The user acknowledges and fully understands that "Belamoshwar" is solely an "intermediary technical facilitator platform" and does not directly provide medical diagnostic or clinical treatment services, nor does it practice medicine.

Full professional, civil, and criminal liability for diagnosis accuracy, medication dispensing, dosages, consultation guidance, and lab test accuracy falls squarely upon the "Platform Partner" (doctor, pharmacist, medical lab) who actually provides the medical service.

🚨 Critical Cases and Emergencies:

"Belamoshwar" is NOT intended for use in life-threatening medical emergencies or urgent strokes/trauma. In such events, the platform strongly advises heading immediately to the nearest accident and emergency department or hospital for immediate emergency care.

Section 08

Seventh: Privacy and Data Protection

The application strictly adheres to user privacy and confidentiality of medical records and personal data in accordance with information security and data protection regulations in the Republic of Sudan.

No user data will be disclosed or shared except with the "Service Provider" selected by the user (such as sending a prescription to a pharmacy or patient file to a doctor), or pursuant to a binding court order or legal mandate.

The platform is entitled to utilize operational data after completely anonymizing identities for statistical research, system optimization, and healthcare quality advancement.

Section 09

Eighth: Technical Liability Boundaries

"Belamoshwar" bears no liability for direct or indirect damages arising from:

Service interruption or slow connectivity caused by public internet and telecommunication service providers in Sudan.

Misuse of the application by the patient, or failure to follow physician guidance diagnosed via the platform.

Events resulting from force majeure such as civil unrest, security disruptions, or natural catastrophes.

Section 10

Ninth: Amendments to Terms

The management of "Belamoshwar" holds exclusive rights to update or modify these Terms and Conditions at any time to keep pace with legal or technological developments. Such modifications become effective immediately upon publication within the application. Continued usage after publication constitutes your explicit approval and consent.

Section 11

Tenth: Applicable Law and Dispute Resolution

These Terms and Conditions are governed exclusively by and construed in accordance with the laws and regulations in force in the Republic of Sudan, with the Arabic language serving as the official binding reference language. Exclusive jurisdiction for hearing and adjudicating any dispute arising from use of the application belongs to the competent Sudanese courts.
